Terms & Conditions – 3-Month Membership Plan
1. Eligibility
To purchase a Membership Plan (“Plan”), you must be at least 18 years old and provide a valid debit or credit card at the time of registration. By activating the Plan, you agree to these Terms & Conditions.
2. Plan Duration and Renewal
(a) The initial term of the Plan is 90 days (3 months), commencing on the date of activation (“Commencement Date”).
(b) The Plan will renew automatically for a further 90-day period at the end of the initial term, unless cancelled by the Member in accordance with Clause 5.
3. Payment
(a) A valid debit or credit card must be provided at the time of activation.
(b) Payment for the Plan is taken in monthly instalments. The first charge will occur on the Commencement Date, and subsequent charges will occur every 28 days thereafter.
(c) If payment is declined or fails for any reason, the Company reserves the right to suspend or terminate the Plan immediately.
4. Non-Cancellation During Initial Term
(a) The Plan is non-cancellable during the initial 90-day term.
(b) Members are committed to the full 90-day term and remain liable for all monthly charges even if they cease to use the services.
5. Renewal & Cancellation
(a) Unless cancelled in accordance with this Clause, the Plan will automatically renew for successive 90-day terms.
(b) The Company will send the Member an email reminder at least 14 days prior to the end of the initial 90-day term, asking whether the Member wishes to cancel or renew.
(c) To cancel renewal, the Member must provide notice via the method specified in the email reminder no later than 7 days prior to the renewal date.
(d) If no cancellation is received, the Plan will renew automatically and the Member’s payment card will be charged accordingly.
6. Changes to Terms
The Company reserves the right to amend these Terms & Conditions from time to time. Updated Terms will be posted on the Company’s website, and continued use of the Plan constitutes acceptance of the revised Terms.
7. Termination by the Company
The Company may suspend or terminate the Plan at any time if:
(a) the Member fails to make payment when due;
(b) the Member breaches these Terms; or
(c) the Company ceases to provide the Plan for operational or legal reasons (in which case a pro-rata refund of any unused portion will be provided).
8. Limitation of Liability
The Company’s liability under this Plan shall be limited to the amount paid by the Member for the current 90-day term. The Company shall not be liable for any indirect, consequential, or incidental damages.
9. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of [Insert Jurisdiction], and any disputes shall be subject to the exclusive jurisdiction of the courts of [Insert Jurisdiction].
